This is information we use to improve our relationship with you, the RIVA consumer, create relevant products and focus our marketing efforts on interesting and useful messages (based on your online behavior). It includes publicly available information on social networks, such as (but not limited to): username, posts and photos on social networks. We obtain this information from social networks (e.g. Facebook, Snapchat, Instagram, etc.).

RIVA usage rights for your Instagram pictures

What's that?

Your Instagram photos caught our attention - and we want to share your style with the whole world!For this, we would like to use the photos you posted on Instagram with a RIVA hashtag and spread them out to all our customers as well.

By replying to our RIVA account message in Instagram with "#RIDERIVA" or #RIVACYCLES, you represent and warrant that:

• you are eighteen (18) years of age or older,
• you own all the rights related to your photos,
• you have the permission of any person appearing in your photos to guarantee the rights set forth here,
• the use of your Instagram photos by RIVA does not infringe the rights of third parties, nor does it violate any law, and
• you have read and agree to the following terms and conditions:

What happens if I answer with #RIDERIVA or #RIVACYCLES?

You grant us the right to display your Instagram photos in RIVA materials orMore precisely: you grant RIVA unlimited, non-exclusive, transferable, licensable, perpetual and international use rights to the photos you post or those you have already posted on Instagram with a RIVA hashtag. A "RIVA hashtag" includes any hashtag with the RIVA trademark, the RIVA trademarks or with the name of a RIVA product or campaign.

This means that by replying to the Instagram message with #RIDERIVA or #RIVACYCLES, RIVA will receive unlimited usage rights for your photos with the relevant hashtag, either as physical or digital content. Such use includes, for example, use of the photos in RIVA physical and online stores, RIVA newsletters, RIVA applications, RIVA social media postings, RIVA internal communications, or use on billboards, posters and RIVA reseller websites, as well as other units and campaigns at events. However, RIVA will have no obligation to actually use your photos.

What's in it for me?

Your photos will not only be visible to your Instagram followers, but also to all fans of RIVA products worldwide. You will have the opportunity to inspire others with your style and ideas. To do so, you only need to exonerate and release RIVA from any and all obligation to pay for the use of your photos and for the intellectual property rights related to the use described above by simply answering with #RIDERIVA or #RIVACYCLES.

What if I change my mind later?

You may revoke the rights granted to RIVA at any time, or by deleting the RIVA hashtag, the photo itself or by sending an email to us at [email protected] In addition, for the photos used on the RIVA website, you can click on the "report photo" icon and request removal of the photo.

Why should I give a declaration and guarantee to RIVA?

Because we want to ensure that no rights are violated with the use of your photos. Therefore, by replying with #RIDERIVA or #RIVACYCLES, you represent and warrant that (i) you own all rights related to your photos, (ii) you have the permission of any person appearing in your photos to grant the rights set forth herein, and (iii) the use of your Instagram photos by RIVA does not infringe upon the rights of any third party, nor does it violate any law. In addition, you agree to indemnify, defend and protect RIVA and any agent acting on behalf of RIVA from any claims, damages, liabilities, costs arising from the use of the photos as described above.

Why is there a limitation of liability?

When answering the RIVA message in Instagram with #RIDERIVA or #RIVACYCLES, a license agreement, legal and binding, is concluded between you and RIVAand we want to minimize the legal risks to RIVA with the following limitation of liability. INCLUDING THE LIMITS OF APPLICABLE LAW, IN NO EVENT WE WILL BE LIABLE FOR (i) expenses, damages, charges, costs or special, indirect, incidental or consequential losses, or (ii) lost profits, or (iii) loss of business, contracts, good faith, business opportunities; or (iv) loss of revenue, anticipated savings; or (v) loss or corruption of data or information; or (vi) any degradation that occurs in relation to the USE OF THE TOP DISCLAIMING PHOTOS, WHETHER ARISING FROM CIVILIAN ILLEGAL LAWS, CONTRACT OR ANY OTHER LEGAL THEORY, EVEN IF WE PREVENTLY INFORMED OF THE POSSIBILITY OF OCCURRENCE OF SUCH DAMAGES.
